Bylaws Change for Disciplinary Appeal (a fix of format issue with cut and paste in 8.c.ii)


Keep in mind this will not be voted on at the Planning Meeting Tomorrow! I will bring copies for everyone to look over.

Old:
8. Rules and Regulations
     a. Eryndor follows all rules and regulations as stated by the Dagorhir manual of arms. All of
         these rules are under the interpretation of Eryndor's Executive Board and Envoys. All
         heralds with questions on these rules should speak with an Executive Board member or
         Envoy for clarification. They should also speak with them on the basis of enforcement at
         events and practices. All enforcement will be done by the Executive Board, the Unit
         Council, Envoys, and event coordinators.
     b. Eryndor strives to maintain a physically safe atmosphere during and in between battles.
          i. If a player exhibits unsafe behavior, punishment can be delivered. Example:
           Removal from the event, a ban on attendance from the next event, and all practices
           leading up to the event
          ii. In the event that punishment has been delivered multiple times in this area, the
           individual in question can be brought up for more severe punishments. I.E.
           Banishment for the remainder of the season
     c. Eryndor is committed to fostering an environment of comfort and safety for everyone.
        To achieve this, attendees should refrain from actions that a reasonable person would
         feel would limit, or threaten to limit, the safe enjoyment of events by another person
         or societal standards.
          i. We will not tolerate any form of harassment of participants, specifically in
           the form of race, color, sex, pregnancy, age, national origin, religion, language,
           social origin, disability, genetic information, sexual orientation, relationship
           status, veteran status, gender identity, physical appearance, or body size.
           Participants found to be engaging in harassment may be expelled from events/practices
           without refund and/or banned from future attendance. Violations of this guideline
           can be reported to either Members of the unit running the event/practice or any
           E-Board member.
         ii. Anyone who violates the harassment policy as outlined above would be subject to
           punishment which would include, but is not limited to: being asked to leave from
           the practice or event where the violation occurred, removal of position/title within
           Eryndor (e.g. Envoy, E-Board Officer, etc.) when applicable, or banishment from Eryndor
           practice(s) and/or event(s). It is at the discretion of the E-Board officers to determine
           a commensurate punishment based on the severity of the violation. If in the event one of
           the violators is on E-board then follow the process of formal compliant detailed in
ii.a. However, Eryndor will observe a ZERO-TOLERANCE POLICY towards persons with any association with groups promoting and/or practicing animosity, degeneration, harm, or enslavement of other entire groups of human beings especially on the subject of immutable characteristics (as laid out in line with 8.c.i of these bylaws). Examples include White Supremacists, Neo-Nazis, the KKK, and other hate groups as listed by the SPLC.

a. However, Eryndor will observe a ZERO-TOLERANCE POLICY towards persons with any association with groups promoting and/or practicing animosity, degeneration, harm, or enslavement of other entire groups of human beings especially on the subject of immutable characteristics (as laid out in line with [sign in to see URL] of these bylaws). Examples include White Supremacists, Neo-Nazis, the KKK, and other hate groups as listed by the SPLC.
         iii. Any player banned/suspended/on probation is welcome to appeal the E-board decision.
          a. Players disciplined may appeal this decision immediately. After initial appeal, additional appeals can be made; however, bans for one year or less are granted no additional appeals and banns Greater than one year can be appeal 2 years after the initial appeal. The appeal must be made by written petition to any member of E-Board and shall include a statement of the grounds for reconsideration. The E-Board may request additional information as needed.
          b. Upon the receipt of an appeal, the E-Board will consider the initial evidence against the individual and any additional information offered will be evaluated prior to proceeding further. If there is reasonable evidence to suggest that the appeal process should be started, both the complainant(s) and disciplined individual will be talked to separately.
          c. Once both sides have given their statements, the eboard should convene within a reasonable timeframe to discuss the events. If the appeal happens during an eboard that was NOT the one that passed earlier judgment, the previous eboard will be consulted on it. Overturning or lessening a ban will be done via a supermajority (4/5ths).
          d. The disciplined party will be notified of the E-board decision within 1 week of the vote.
    d. Eryndor strives to maintain a medieval and/or fantasy setting during their battles.
          i. If a player exhibits improper or unacceptable garb at an event in which corrective
        measures fail, then they may face consequences. Example: Unable to participate in
        field battles
     e. Eryndor is recognized as a non-profit organization, and thus subject to U.S. laws and
         regulations
          i. In the events of illegal action such as vandalism, possession, theft, or other actions
        outlawed within the United States, the participant in question can be brought up for
        discussion by the Executive Board for the purpose of deciding appropriate
        consequences.
